Information on processing of personal data
The reuse of public sector information is governed by the Act of 11 August 2021 on Open Data and the Reuse of public sector information (Journal of Laws 2021, item 1641).
Everyone has the right to reuse public sector information made available in:
- the Public Information Bulletin of the obliged entity;
- the Central Repository of Public Information Strona główna - Otwarte Dane;
- another ICT system of the obliged entity;
- information provided upon a request for reuse.
Public sector information is any content, or part of it, regardless of its form of recording, that is held by an obligated entity. It is therefore any information held by a public institution. It can take any form, e.g., paper, electronic, audio, visual, audiovisual.
The reuse of public sector information refers to any further use of public sector information, e.g., in products, services, or applications, by businesses, non-governmental organizations, or any interested person.
The right to reuse is subject to restriction in the scope and under the conditions specified in the provisions on the protection of classified information and other statutorily protected secrets. The right to reuse shall be subject to limitation with respect to information that is public sector information to which access is restricted under other laws.
The minister responsible for IT matters shall be the appeal body against decisions on refusal to grant permission to reuse public sector information and against decisions on conditions for reuse or on the level of fees for reuse.
To the extent not regulated by the Act of August 11, 2021 on open data and reuse of public sector information to the decision on refusal to grant permission to reuse public sector information and to the decision on conditions for reuse or on the amount of fees for reuse, the provisions of the Act of 14 June 1960 shall apply – Code of Administrative Procedure (Journal of Laws of 2021, item 735 and 1491)

The application shall be processed without undue delay, no later than 14 days following the receipt of the application. If it is not possible to process the application within this timeframe, the Applicant will be informed of the reasons for the delay in providing the information and a new deadline, but no longer than 2 months from the date of application.
Public sector information shall be made available or transmitted for reuse free of charge. However, a charge may only be levied if preparing or transmitting the information in the requested manner or form involves additional costs.
Entities reusing public information from Statistics Poland are required to provide the following information:
- the source, time of creation and acquisition of the information from Statistics Poland;
- information about the processing of the reused information.
Statistics Poland is not responsible for the results of processing reused information.
